  3. Digitizer Technology Company ("DTC") hereby grants to you, and you accept,
  4. a non-exclusive license to use one copy of the Virtual Tablet Interface(tm)
  5. ("SOFTWARE") on a single computer only. You acknowledge and agree that the
  6. SOFTWARE is a proprietary product of DTC and is protected under US
  7. copyright law, international treaty provisions, and trade secrets of
  8. general applicability. You further acknowledge and agree that all rights,
  9. title, and interest in and to the SOFTWARE are and shall remain with DTC.
  10. You may retain one copy of the original program disk(s) solely for backup
  11. purposes after loading the SOFTWARE in a single computer, or you may make
  12. one copy of the SOFTWARE solely for backup purposes. You may not rent,
  13. lease, disassemble, decompile, or reverse engineer the SOFTWARE. This
  14. license shall be construed and governed in accordance with the laws of the
  15. State of Washington. Should any term of this license be declared
  16. unenforceable by any court of competent jurisdiction, such declarations
  17. shall have no effect on the remaining terms hereof.

  19. DTC DISCLAIMS ALL WARRANTIES RELATING TO THIS SOFTWARE, WHETHER EXPRESS OR
  20. IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANT-
  21. ABILITY OR FITNESS FOR A PARTICULAR PURPOSE. DTC WILL NOT BE LIABLE FOR ANY
  22. SPECIAL, INCIDENTAL, CONSEQUENTIAL, INDIRECT OR SIMILAR DAMAGES DUE TO LOSS
  23. OF DATA OR ANY OTHER REASON, EVEN IF DTC OR AN AGENT OF DTC HAS BEEN
  24. ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL DTC'S
  25. LIABILITY FOR ANY DAMAGES EVER EXCEED THE PRICE PAID FOR THE LICENSE TO USE
  26. THE SOFTWARE REGARDLESS OF THE FORM OF CLAIM. THE PERSON USING THE SOFTWARE
  27. BEARS ALL RISK AS TO THE QUALITY AND PERFORMANCE OF THE SOFTWARE.

  36. Distribution

  38. The evaluation version of the SOFTWARE may be distributed as set forth
  39. herein. Registered versions may not be distributed in any form whatsoever.
  40. The SOFTWARE may not be offered for sale, or included with another product 
  41. offered for sale without the express written permission of DTC. This
  42. includes, but is not limited to, "public domain / shareware" disks or hard
  43. disk drives containing "public domain / shareware" which are sold for
  44. profit.  National services such as CompuServe, GEnie, CONNECT, America
  45. Online; BBSs which charge a fee for membership but not for each download;
  46. and non-profit, valid computer user groups or clubs may distribute the
  47. evaluation version in its entirety only. (Note that the evaluation version
  48. is limited to a 30-day trial period. If you distribute the evaluation
  49. version you must do so with an unused copy as downloaded from the networks.)
